The fact is that smoking is now banned in all public indoor spaces in the UK.  The UK smoking ban follows similar decisions made in several parts of Europe and the USA and came into force in the summer of 2007.

People are still allowed to light up outdoors, in their own home or places considered to be 'homes', such as prisons, care homes and hotel rooms but the smoking ban can sometimes include certain outdoor locations that are 'substantially enclosed', such as football grounds and railway platforms.

If customers are caught smoking in a banned area they can be fined £50 but more importantly, as the person in charge of the premises, you could face a £2,500 fine if you fail to stop them. You could also be charged on-the-spot fines of £200 if you fail to display no-smoking signs, with the penalty increasing to £1,000 if the issue goes to court.

Currently, the definition of a smoking shelter is a structure with, or without, a roof that has no more than 50% enclosed sides.  Anymore than this and the above penalties will still apply if people are allowed to smoke in it!
